1. INTRODUCTION
It is important to us that you feel safe with, and are informed about, how we handle your personal data in our recruitment process. In connection with Danske Commodities A/S and its subsidiaries’ (collectively “DC”) recruitment procedures, we process your personal data in accordance with this Standard.
DC is the data controller in connection with our recruitment procedure. If you are seeking employment in a DC subsidiary, DC A/S and your prospective employer are jointly responsible for the processing of your personal data.
As DC is headquartered in Denmark, the governing legislation will be the EU’s General Data Protection Regulation (“GDPR”).
This Privacy Standard applies to you as a private individual applying for a job at DC, and sets out how DC uses, stores, and protects any information that you give us in the job application process.
2. COLLECTION OF PERSONAL DATA
Your personal information is obtained through the application and recruitment process, this may be directly from you, via an employment agency, or a third party who undertakes background checks.
We may occasionally request or search for further information from third parties including, but not limited to, source such as Facebook or LinkedIn, previous employers, etc.
In cases where the applicant is referred by an existing employee, DC may collect general and non-confidential information about the applicant from the employee.
3. PROCESSING OF PERSONAL DATA
At DC, we process your personal data confidentially and in accordance with applicable data protection laws.
The purpose for the collection and processing of your personal data is to manage and facilitate recruitment of employees to our business.
3.1. VISTING THE CAREER PORTAL
When you visit the DC career portal we collect the following categories of personal data:
DEVICE INFORMATION IP: address, browser type and version, session behaviour, traffic source, screen resolution, preferred language, geographic location, operating system and device settings/usage.
TECHNICAL & STATISTICAL DATA: Information about which URLs you visit, and your activity on the site.
Our legal basis is the following provisions in EU GDPR:
LEGITIMATE INTEREST: Processing is necessary to fulfil the legitimate interest of DC to facilitate and optimise the recruitment process, cf. Art. 6(1)(f).
DC has deemed that these interests override any interests or rights you may have which require the protection of personal data. Special regard is given to the reasonable expectations of you as an applicant in the job recruitment process, and the fact that the processing is ultimately also in your interest.
3.2. THE APPLICATION PROCESS
During the application process we collect the following categories of personal data:
GENERAL PERSONAL DATA Name, address, contact information (phone number, email), and other personal details which can be used to identify you.
CONFIDENTIAL PERSONAL DATA Information subject to a duty of confidentiality, such as professional qualifications, education, etc.
Our legal basis is the following provisions in EU GDPR:
CONSENT The applicant consents to the collection and processing of their personal data with the purpose of recruitment, as described in this privacy standard, when the applicant makes and submits their application through the DC careers portal, cf. Art. 6(1)(a).
The applicant has the right to withdraw their consent at any time, by contacting DC using the contact details listed under section 8. Using this right may however mean that the applicant cannot apply for a specific job or otherwise use or participate in the applications process.
LEGITIMATE INTEREST Processing is necessary to fulfil the legitimate interest of DC to facilitate recruitment, cf. Art. 6(1)(f).

3.3. THE INTERVIEW PROCESS
During the interview process we collect the following categories of personal data:
CONFIDENTIAL PERSONAL DATA Information subject to a duty of confidentiality, such as a personality and a cognitive test, salary and employment conditions, etc.
SENSITIVE PERSONAL DATA Health information is collected only when relevant e.g., to be able to make reasonable adjustments and accommodations in the workplace, or for compliance with applicable laws and employment-related requirements in case of flex job or employment on special terms (i.e. disability).
Our legal basis is the following provisions in EU GDPR:
LEGAL OBLIGATION Our processing of any health information to ensure our compliance with national legal obligations, including any labour law obligations and our legal obligations to ensure a safe work environment, cf. Art. 9(2)(b) and Art. 6(1)(c).
LEGITIMATE INTEREST Processing is necessary to fulfil the legitimate interest of DC to facilitate recruitment, cf. Art. 6(1)(f).

3.4. THE HIRING PROCESS
If you are selected for a position, prior to your first day of employment we collect the following categories of personal data (if not already provided):
GENERAL PERSONAL DATA: Name, address, date of birth, contact information (phone number, email), and other personal details which can be used to identify you.
CONFIDENTIAL PERSONAL DATA: Information subject to a duty of confidentiality, such as national identification numbers, banking details, tax information, payroll information, information about income and financial situation, and employment conditions.
SENSITIVE PERSONAL DATA: Health information is collected only when relevant e.g., to be able to make reasonable adjustments and accommodations in the workplace, or for compliance with applicable laws and employment-related requirements in case of flex job or employment on special terms (i.e. disability).
Our legal basis is the following provisions in EU GDPR:
CONTRACTUAL OBLIGATION: Processing is necessary for the performance of your employment contract such as fulfilling the contractual obligations we have with you., cf. Art. 6(1)(b).
LEGAL OBLIGATION: Our processing of any health information to ensure our compliance with national legal obligations, including any labour law obligations and our legal obligations to ensure a safe work environment, cf. Art. 9(2)(b) and Art. 6(1)(c).
LEGITIMATE INTEREST: Processing is necessary to fulfil the legitimate interest of DC to facilitate recruitment, cf. Art. 6(1)(f).

4. SECURITY & DATA TRANSFER
We are committed to ensuring that your information is secure. To prevent unauthorised access or disclosure, we have put in place suitable physical, electronic, and managerial procedures to safeguard and secure the information we collect.
DC may share your personal data with:
- Subsidiary companies to DC A/S.
- Suppliers (data processors). Such suppliers will process the personal data on behalf of DC and in accordance with the instructions given by DC.
- Group affiliated companies.
- To parties involved in legal proceedings. If needed to protect or defend our rights, we will share your personal data with public authorities or with other parties involved in a potential or existing legal proceeding.
The global nature of our business means that your personal data may be disclosed to members of the Equinor and DC group companies outside the European Economic Area (“EEA”), for example, to DC entities located in the United States, or Singapore, for us to cooperate and function as a global business.
DC has an intra-group data transfer agreement in place which regulates cross-border transfers of your personal data within the group. Where third parties transfer your personal data outside of the EEA, we will take steps to ensure that your personal data receives an adequate level of protection, including by, for example, entering into data transfer agreements or by ensuring that third parties are certified under appropriate data protection schemes.
5. RETENTION
All candidate information and documents are stored in our recruitment system and automatically deleted after 6 months if the candidate is not selected.
However, you have the option to provide consent for DC to retain your personal data in our internal job bank. By giving this consent, we may also share your application internally if we believe there is a potential match with another role within our organisation. This allows us to contact you about future job opportunities if you are not successful in the initial recruitment process.

6. YOUR PRIVACY RIGHTS
Under applicable Data Protection legislation, you have the following rights in relation to our processing of your personal data:
RIGHT TO WITHDRAW CONSENT You have the right to withdraw your consent at any time, by contacting DC using the contact details listed under section 8. Using this right may however mean that you cannot apply for a specific job or otherwise use or participate in the applications process.
RIGHT TO ACCESS: You have the right to request access to your personal data and request a copy of your personal data.
RIGHT TO RECTIFICATION: You have the right to correct inaccurate personal data about you.
RIGHT TO OBJECT: Under certain circumstances, you may have the right to object the processing of your personal data, on grounds relating to your particular situation, at any time.
RIGHT TO ERASURE: Under certain circumstances you may have the right to have personal data erased.
RIGHT TO DATA PORTABILITY: In certain circumstances, you have the right to receive your personal data in a structured, commonly used, and machine-readable format, and you have the right to transmit this data to another controller without hindrance.
7. AUTOMATED DATA PROCESSING
In accordance with GDPR Art. 22, your application will not be subject to fully automated decision-making processes.
All decisions regarding your application are reviewed and made by our recruitment team and/or the hiring manager to ensure a fair and transparent evaluation.
